Pine Ridge Assisted Living

Stina Denk, a former employee of Pine Ridge Assisted Living Centers, filed a class and collective action against Pine Ridge claiming that Pine Ridge engaged in various activities that violated both Wisconsin's wage laws and the Fair Labor Standards Act. First, Ms. Denk alleges that Pine Ridge failed to pay its hourly employees for hours worked over eight in a day under the 8/80 overtime system. Second, Ms. Denk alleges that Pine Ridge shaved time from its hourly employees' time cards to reduce these employees' compensation. Finally, Ms. Denk alleges that Pine Ridge permitted its employees to work off the clock.

The Court granted Plaintiff's motion for conditional certification of allowing the lawsuit to proceed as a collective action. The Court's order is available here. Included in the collective action class are all hourly employees who worked at either the Pine Ridge Colby or Pine Ridge Wisconsin Rapids facilities.


UPDATE 11/13/2011 - The parties have engaged in mediation and continue to engage in discussions about resolving the case.

UPDATE 5/3/2012 - The parties have reached an agreement.  Pine Ridge Assisted Living et al. have served upon Plaintiff's Counsel an offer of judgment.  An acceptance of that offer was filed with the court on May 3, 2012.  A letter regarding this matter and a worksheet has been mailed to each individual who submitted an opt-in form and is taking part in this lawsuit on May 3, 2012.  Please return the worksheet as soon as possible.  If you have any questions or concerns, please contact our firm at 414-224-0000 or through our website.

UPDATE 7/25/12 - Since the filing of the accepted offer of judgment on May 3, 2012, the Court requested additional information prior to approving the settlement. The Parties submitted a joint report on July 6. Shortly after the Court approves the settlement and enters a judgment against Pine Ridge Assisted Living et al., the settlement funds should be distributed. At this time, there is no timeline for how long it will take the Court to approve the settlement. UPDATE 8/7/12 - The Court entered an order this morning approving the settlement in this matter. We anticipate having the settlement checks in the near future. UPDATE 9/22/12 - Pine Ridge is currently processing the settlement checks in this matter. This has been a difficult process and is expected to conclude in the next few weeks.
