Beer Capitol Distributing, Inc.

Matthew Tobin, a beer Merchandiser for Beer Capital Distributing, Inc., filed a class action lawsuit against the company today on behalf of himself and about 60 of his co-workers. The lawsuit alleges that shortly after Beer Capitol Distributing acquired another distributor, Miller Brands-Milwaukee, LLC, in 2008, the company began paying their Merchandisers a salary rather than on an hourly basis. With this change, the company stopped paying their Merchandisers overtime compensation. 


Mr. Tobin alleges Beer Capital Distributing, Inc. violated both Wisconsin state wage laws and the Fair Labor Standards Act by not paying him and his fellow Merchandisers overtime premium compensation - time and one-half - for each hour they worked over forty hours a week.

UPDATE - 9/22/2012 - After a full day's mediation, the parties have come to a tentative settlement of this lawsuit. The settlement is on a class wide basis and must receive both preliminary and final approval by the Court. The parties will ask the Court for preliminary approval in early October. We will keep you updated on the status of this as the matter proceeds through settlement.
