JT Packard / Thomas & Betts Power Solutions

Brian Teed, a former field engineer for JT Packard, filed a collective action against JT Packard on behalf of himself and his fellow field engineers.  The lawsuit alleges that JT Packard violated the Fair Labor Standards Act by failing to pay overtime compensation to its field engineers.  The FLSA guarantees employees, even those paid a salary, premium compensation at a rate equal to time and one-half the regular rate for all hours worked over forty in any workweek.  During the period at issue in the lawsuit, JT Packard paid its employees a salary without overtime compensation. 

On November 23, 2010, the Court granted Plaintiff's motion to have Thomas and Betts Power Solutions substituted in as a Defendant in the matter as Thomas and Betts purchased the assets of JT Packard and operated essentially the same business after the sale. UPDATE May 10, 2012:  After mediating the matter on multiple occasions, the parties agreed to a settlement.  Thomas & Betts served upon Plaintiffs' Counsel an offer of judgment for damages in the amount of $145,250 plus an award of Plaintiffs' Counsels' reasonable attorneys' fees and costs. Thomas & Betts' offer of judgment is conditioned upon Thomas & Betts' appeal to the Seventh Circuit Court of Appeals of the Court's order substituting Thomas & Betts as a Defendant in the matter.
